Yes, because a film's quality is defined by its sequels. That's why Transformers 2 is great, it's getting a sequel.
Transformers 2 is a successful movie, not a good, Superman Returns has neither good or successful, yeah its better then Transformers 2, but that's not something to be proud of.
Well, The Incredible Hulk barely made 175% of its budget and its getting a sequel. It seems that other factors are involved.

Superman Returns had as much action as any other average superhero movie (the plane, Metropolis earthquake, the ending). Problem is that action for many people is punching someone else.
The Earthquake didn't even involve Superman, so barely even counts, I want to see action involving Superman, not some random Earth quake. I want Superman doing something, not just a random Earth quake, I would be disappointed if Spider-Man 2, half the movie involved some earth quake that Spider-Man doesn't deal with. The lifting of the island is pretty dull compared to the Dr. Octopus vs. spider-Mn fight or even the Wolverine vs. Deathstrike fight, so it fails to measure up. Superman just lifting something doesn't have the same back and forth tension that a fight scene would have had.
All of that supposed action sucks in comparison to a ton of comic book movies I can think of. Was there any good reasons why Superman couldn't have fought someone in the movie? 5 Superman moves and only Superman II had any good fight scenes. What a waste.
Lifting something deosn't sound as a climax unless you know it's Superman and a mountain of Kryptonite in order to save Earth. Three people and a gun talking doesn't sound the classic action-packed climax, but it worked for The Dark Knight.
There several well done action scenes in Dark Knight before that, so you can't compare the action in Dark Knight to the action to superman returns, TDK kicks its butt in that regard.
Also the climax in Superman returns made no sense. Earlier in the film Superman was nearly killed just by standing near kryptonite almost killed him and then he can just lift a mountain of it, with no explanation. What happened, did he just will power to shrug it off, makes it seem kinda useless doesn't it? Why didn't he just shrug it off in the first movie. Heck why did they use kryptonite again, that just made the whole thing a retread of the previous movies, as noted here.

As yeah the action in Superman Returns , really sucked and was almost non existent! But hey, who wants action in an action movie? Well we are at it, why not make a comedy with almost no jokes in it.
Yeah, and then again they have a little legal problem that you forgot to mention.
The law suit was in 2009, why couldn't they have made a new Superman movie in 2008? Maybe because it was disappointing.
