I imagine with the movie already having a number of Batman's top pick villains, Catwoman, Riddler, Penguin, Two-Face, Falcone being in this is probably not true. If he is in the movie, it's probably going to be a small role, and thus not have a big star attached.

So far he hasn't been wrong about this movie (his website broke the Zoe Kravitz story) and seeing how the film appareantly takes inspiration from Long Halloween I do believe he's in the film.

The dude works for a trade now, he's more trustworthy nowadays.

De Niro would be a good Falcone, if he was in "giving a crap" mode, but also a very cliche casting choice.

For someone a little lower-profile, maybe someone like Ciaran Hinds or Bruce McGill?

Yeah, I'd only choose him if Falcone's role in this movie is considerable enough or if he has enough good scenes there to really allow him to make an impact. If not, save him for another villain. We don't want a repeat of the Godzilla fiasco.
